That picture is misleading, it was a nailed on penalty.

Well same happened last season's back when playing Liverpool you got a penalty and it should have also been a free kick, cause the contact was made outside the box but United got a penalty as Valencia fell inside the box after getting challenged by Mascherano.

But i was watching that tackle on Ramirez and i think there is no real contact until his leg come's back down, and he Ramirez is very close to being on the line if not on it when the challenge is made but its a close one.

Might be a good idea in the long run. I know in Egypt for the big Cairo derby they always have a foreign ref because they know things be a total disaster if they had a regular ref for that match. When a single match means as much as this one most likely will matter I think a foreign ref is a good idea.
