I don't know how the justice system works in Scotland, but in England and Wales eyewitness testimony qualifies as evidence.
"Acts of defiance" are not permitted under the laws of the game, celebrations are only supposed to be expressions of joy. I think it's pretty clearly he was trying to wind up Diouf to provoke a response, considering it was in the middle of the game.
